Brexit: What the Cosmetic Industry needs to know

On the 1st January 2021, the EU cosmetic product regulation EC No.1223/2009 will no longer apply to companies placing cosmetic products on the UK market.  A new UK cosmetics regulation will come into force.  

Who can you appoint as the Responsible Person?

All cosmetic products placed on the market must have a responsible person who ensures the products are compliant with the cosmetics regulation. Under the new UK cosmetics regulation, the responsible person must be based in the UK.  Companies intending to place cosmetic products on to the UK market must have a UK address or appoint a UK third party service provider.  Likewise, any UK company wishing to place products on the EU market must have an EU address or appoint an EU third party service provider. 

How long do you have to notify your cosmetic products?

All cosmetic products being placed on the UK market will need to be notified to the new UK notification database.  Companies have 90 days from the 1st January 2021 to notify their cosmetic products that are already on the market.  Yordas can assist with notifications to both the UK database and EU CPNP.
