Action required! Check your GB Article 95 active substance supply is compliant now

The HSE has published a list of GB Article 95 entries planned for removal following Brexit.

This will mean if action is not taken by the company supporting the Article 95 entries, the active substance supply will no longer be compliant with Article 95 of the Biocidal Product Regulation and companies this entry supports will have to look for an alternative supplier or possibly opt to support an Article 95 entry themselves through submission or representation in the UK.

Therefore, companies affected or their active substance supplier must ensure action is being taken to remain on the GB Article 95 list and secure the active substance supply in the UK. 

To remain on the GB Article 95 list there has been a requirement for the supplier to provide the following information:

  • Confirmation of being established in the UK (GB&NI)

  • Resubmission of the data dossier or Letter of Access to a relevant data dossier supporting the Article 95 active substance entry

The current Article 95 entry status can be found in the GB Article 95 list transitional status column and if all requirements have been met it will show the entry ‘All requirements met’. If your active substance has not got this status action needs to be taken to address the requirements previously mentioned if the company supporting the entry wants to remain on the list. The deadline has now passed for letting the HSE know your intention to submit the additional information they require for the active substance to stay on the list therefore we would suggest getting in touch with the HSE ASAP to let them know you would like to submit the evidence they require.

Suppliers that fail to submit the required information to remain on the GB Article 95 list to the HSE will be removed on the 3rd of March 2025.
