The Industrial Act 2019 is the legal framework for the regulation of the importation and manufacture (introduction) of “industrial chemicals” in Australia. It was introduced to establish the Australian Industrial Chemicals Introduction Scheme (AICIS). AICIS took effect on 1 July 2020. It aims to help protect human health and the environment, to manage the possible risks and to provide for the collection and publication of information about industrial chemicals.
Two questions determine whether or not you need to register your business according to AICIS:
Is your substance an industrial chemical?
What is your role in the supply chain?
If a business imports or manufactures an industrial chemical in Australia, they are referred to as introducers and are required to register their businesses by completing an online form and paying the relevant fee.
Registering under AICIS
The data requirements differ based on the category of chemical introduction.
The main categories are:
Listed Introductions:
A chemical which is listed on the Inventory and already available for industrial use in Australia. Remember that not all listed chemicals have the same requirements.
Exempted Introductions:
The chemical must meet a very strict set of criteria for a very low risk to both human health and the environment.
Reported Introductions:
The chemical must meet the criteria for low risk to human health and/or the environment. These chemicals will not be listed on the Inventory following pre-introduction reporting.
Assessed Introductions:
The chemical must meet the criteria for medium to high risk to human health or the environment. It must be assessed and be issued an assessment certificate before import or manufacture.
Commercial Evaluation:
An alternative option to the exempted, reported or assessed categories. Only eligible to those testing the commercial potential of an industrial chemical.
Exceptional Circumstances Introduction:
The Minister can also authorise introductions under this category.
