Plastics in contact with food Regulation Annex I amended

Commission Regulation (EU) No. 10/2011 on plastic materials and articles intended to come into contact with food has been amended as per Commission Regulation (EU) 2023/1442 of 11 July 2023 and Commission Regulation (EU) 2023/1627 of 10 August 2023.

Commission Regulation (EU) 2023/1442 and Commission Regulation (EU) 2023/1627 insert the following substances in Annex I:

  1. Tris(2-ethylhexyl)benzene-1,2,4-tricarboxylate

  2. (Triethanolamineperchlorate, sodium salt) dimer

  3. N, N-bis (2-hydroxyethyl)stearylamine partially esterified with saturated C16/C18 fatty acids

  4. Phosphoric acid, mixed esters with 2-hydroxyethyl methacrylate

  5. Benzophenone-3,3',4,4'-tetracarboxylic dianhydride (BTDA)

  6. Bis(2-ethylhexyl)cyclohexane-1,4-dicarboxylate (DEHCH)

The following substances, already listed in Annex I, have been amended:

  1. Phthalic acid, dibutyl ester (DBP)

  2. Phthalic acid, benzyl butyl ester (BBP)

  3. Phthalic acid, bis (2-ethylhexyl) ester (DEHP)

  4. Phthalic acid, diesters with primary, saturated C 8-C 10 branched alcohols, more than 60 % C 9 (DINP)

  5. Triethanolamine

  6. Perchloric acid, salts (perchlorate)

  7. Diethyl[[3,5-bis(1,1-dimethylethyl)-4-hydroxyphenyl]methyl] phosphonate

  8. Poly((R)-3-hydroxybutyrate-co-(R)-3-hydroxyhexanoate) (PHBH)

  9. Phosphorous acid, triphenyl ester, polymer with alpha-hydro-omega-hydroxypoly[oxy(methyl-1,2-ethanediyl)], C10-16 alkyl esters

The following substances have been removed from Annex I:

  1. Wood flour and fibers, untreated

  2. Salicylic acid
