With the widespread usage of chemicals worldwide, a Globally Harmonized System of Classification and Labelling of Chemicals (GHS) was created to standardise the hazard communication material of chemicals, for example, through chemical product labelling and Safety Data Sheets (SDS). 

In South Africa, as of September 2022,  substances and mixtures intended to be used at a workplace must comply with the classification, labelling, packaging, and safety data sheet requirements as laid down in the Regulations for Hazardous Chemical Agents, 2021 that implement GHS rev 8 of 2019.

Companies have been able to use GHS-compliant classifications and safety data sheets on a voluntary basis since 2012 through the South African National Standard (SANS) 10234. The Regulations for Hazardous Chemical Agents, 2021 now make such requirements obligatory.

The Regulations also cover other health and safety aspects when working with hazardous chemicals, such as air monitoring, medical surveillance and disposal. 

Who Does This Apply To?

All manufacturers, importers, suppliers and retailers of hazardous chemical substances and mixtures intended to be used in a workplace.

The GHS requirements for classification, labelling and SDSs are not applicable to foodstuffs, cosmetics or pharmaceuticals in their final form.

What are the risks if a company chooses not to comply?

Non-compliance is deemed a criminal offence which can lead to fines or a maximum of 6 months imprisonment. In the case of continuous violation, an additional fee of R500 per day or an additional imprisonment day for each day the offence continues.

Progress across Africa

Several countries in Africa are progressing on implementation. Kenya, Ghana, Côte d'Ivoire and Nigeria are starting a four-year project to improve their chemicals management, with the aim of implementing the UN’s Globally Harmonized System of classification and labelling of chemicals (GHS). Meanwhile, Rwanda has begun the process of implementing GHS.
