BREXIT GB BPR—ACT NOW

What is the GB-BPR?

With the Transition Period ending on 31 December 2020, the UK will put in place its own regulatory frameworks for biocides.

The GB-BPR will cover the same broad range of products as EU-BPR. These fall under four main types:

  1. Disinfectants (cleaners, algicides, etc.)

  2. Preservatives (in products from cosmetics to construction materials)

  3. Pest control (including repellents for use on humans, such as insecticides), and

  4. ‘Other’ (including antifouling products).

What do you need to do to comply with GB-BPR?

While the new legislation will be similar to the EU BPR, there are some actions you need to take quickly to ensure the continuity of your supply chain of biocides in the UK.

You must resubmit Applications for Active Substance approval and Product Authorisation. These must be resubmitted to the UK Health & Safety Executive (HSE) from January 2021.

Application resubmission deadlines for companies:

  • 90 or 180-day resubmission deadlines for ongoing product/active substance applications;

  • A 2-year deadline to resubmit data to remain on Article 95.

In addition, companies must be established in the UK to be listed on UK Article 95 and must apply for product authorisation by December 31st 2021. If you do not have a legal entity in the UK, Yordas can act as your authorisation holder or UK representative.
